To subdivide land in three stages as a non-complying activity in the Residential and Rural Production zones of the Operative Far North District Plan; creating separate titles for 94 townhouses/residential units, two vacant lots, a balance lot, road to vest, access lots, parking lots, local purpose (esplanade) reserve, recreation reserve, and a private lot for stormwater management/drainage purposes. The subdivision cannot accommodate a square building envelope measuring 14 metres by 14 metres (excluding the permitted activity boundary setbacks) within the residential lots. Land use consent is required as a non-complying activity in the Residential zone and District wide rules of the Operative Far North District Plan for breaches to the permitted activity thresholds relating to residential density; building height, setbacks, and sunlight angle; noise; earthworks; reducing the minimum width of an esplanade reserve; buildings within 30 metres of a wetland; vehicle movements; parking spaces; private road; access and works within a road reserve.
